Liability Waiver, Release and Assumption of Risk Agreement

This Liability Waiver, Release and Assumption of Risk Agreement (“Waiver”) is made by the undersigned Releasor(s), including Releasor’s agents, heirs, personal representatives, administrators, successors, and assigns (hereinafter “Releasor”) to and in favor of Toledo’s P.E.T. Bull Project, Inc., and its employees, board members and volunteers (collectively, “TPBP”).

In consideration of low cost or free spay and/or neuter services provided by West Toledo Animal Hospital (the "Activity"), Releasor hereby agrees as follows:

Toledo's PET Bull Project will only pay for the agreed upon spay/neuter surgery. Toledo's PET Bull Project is not responsible for any other medical services requested by you, the dog’s owner/guardian, and will not pay for said services.
Releasor understands and acknowledges that all services provided pursuant to this program will be exclusively provided by West Toledo Animal Hospital. TPBP does not and will not direct, control, or administer the provision of any services.
Releasor further understands and acknowledges that TPBP makes no warranties or representations regarding the scope or nature of services provided by West Toledo Animal Hospital or anyone working on its behalf.

In recognition of the above, the Releasor and anyone asserting claims on their behalf release and forever discharge:

TPBP and its shareholders, directors, officers, affiliates, board members, employees, volunteers, agents and representatives and each of their respective successors and assigns (collectively, "TPBP Releasees"), and
TPBP Volunteer, personally, and his or her heirs, personal representatives, agents, successors and assigns (collectively, "TPBP Volunteer Releasees", and together with the TPBP Releasees, individually a "Releasee" and collectively, "Releasees")

from causes of action of any nature and kind, known or unknown, which Releasor may have arising out of or relating to the Activity. This Waiver applies to any cause whatsoever including without limitation negligence on the part of any Releasee or other Activity participant.

Entering this Waiver and by agreeing to participate in the Activity, Releasor is not relying on any oral, written or other representations or statements by any TPBP Releasee or any other inducement or coercion to participate in the Activity. Releasor confirms that, by their own free will, Releasor has read and understood the terms of this Waiver and Release and agrees that they are binding on Releasor and their heirs, next of kin, personal representatives and successors and assigns.

5. General Provisions

This Waiver shall be binding upon the undersigned Releasor and their heirs, administrators, personal representatives, successors and assigns. Releasor certifies that they have the authority to waive and release all Claims and have not assigned or transferred any Claims to any other party.

The provisions of this Waiver are severable. If any provision is held to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision. This Waiver constitutes the entire agreement between the parties and supersedes any prior oral or written agreements or understandings between the parties concerning the subject matter of this Waiver.

This Waiver may not be altered, amended or modified, except by a written document signed by both parties. The terms of this Waiver shall be governed by and construed in accordance with the laws of the State of Ohio.

Releasor has carefully read and fully understands all the provisions of this Waiver and is freely, knowingly and voluntarily entering into this Waiver.*
